Digital Millennium Copyright Act Notice and Policy
EgoEase LLC (“the Company”), operator of the website fulfilledhumans.com (“the Site”), respects the intellectual property rights of others and requires its users to do the same. The Company will respond to allegations of copyright violations in accordance with the Digital Millennium Copyright Act (“DMCA”).
Upon receiving a valid DMCA notification, the Company will promptly take down the allegedly infringing content. The party whose content is removed will be notified and allowed to submit a counter-notification. If a valid counter-notification is received, the content will generally be restored unless the complaining party files a legal action seeking a court order to restrain the alleged infringer from engaging in the infringing activity.
1. To File a Notification of Infringing Content
To be effective, a written notification of claimed infringement must be sent to our designated DMCA Agent. The notification must include substantially the following:
- A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
- Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works.
- Identification of the material that is claimed to be infringing and information reasonably sufficient to permit the Company to locate the material.
- Information reasonably sufficient to permit the Company to contact you, such as an address, telephone number, and, if available, an email address.
- A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
2. To File a Counter-Notification
If your content has been removed, you may file a counter-notification with our DMCA Agent. The counter-notification must be a written communication that includes the following:
- Your physical or electronic signature.
- Identification of the material that has been removed and the location at which the material appeared before it was removed.
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or Sheridan, Wyoming if your address is outside of the U.S.), and that you will accept service of process from the person who provided the original infringement notification.
3. Repeat Infringer Policy
In accordance with the DMCA and other applicable law, EgoEase LLC has adopted a policy of terminating, in appropriate circumstances and at the Company’s sole discretion, users who are deemed to be repeat infringers. The Company may also at its sole discretion limit access to the Site and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.
